Limitation of liability
DIN Software GmbH provides data and information based on its database containing over 700,000 standards, technical rules and regulations published by over 280 national, European and international organizations. This data and information is provided exercising the due diligence of a prudent business person and to the best of our knowledge and ability. DIN Software GmbH does not provide any guarantee as regards the currency, accuracy or completeness of the data and/or information delivered, particularly that data and/or information relating to standards and technical rules that are not published by DIN but are drawn up and supplied to DIN Software GmbH by other publishers under their own responsibility. DIN Software GmbH shall have unlimited liability only in cases of intent, gross negligence or where damages arise from injury to life, body or health, where liability is compulsory as stated in the Produkthaftungsgesetz (German Product Liability Act), or to the extent of any guarantee given by DIN Software GmbH. In the case of a slightly negligent breach of an obligation that is essential for achieving the purpose of the contract (cardinal duty) liability shall be limited to damages that are foreseeable and typical according to the type of business in question. Any further liability of DIN Software GmbH is excluded. The above limitations of liability also apply to the personal liability of staff, representatives and organs of DIN Software GmbH.
